On September 13, 2018 the Colombian Trademark Office issued the Resolution No. 68023 which rejected the opposition filed by ITALCOL S.A.; thus, allowing the registration of the trademark SUPERCAT DELI + graphic to identify products covered in international class 31 requested by our client ALIMENTOS CONCENTRADOS RAZA LTDA.
According to the Trademark Office the ius prohibendi of the opposing sign only protected the capricious union of the words DELI and CAT, this means that the right the company owns to prevent third parties from using the sign resides only in the exact reproduction of this elements and not in each of the words separately.
Hence, the Colombian Trademark Office reaffirmed that the comparative analysis of trademarks has to take in consideration visual, phonetical and conceptual aspects.
