Based on our strategy, PALM ANGELS S.R.L. opposed to the registration of the trademark PALM ANGELS + (Graphic) requested by SANTIAGO URIBE UPEGUI.
As main arguments, our client highlighted that the requested trademark was blatantly identical and confusing with its trademark PALM ANGELS + Graphic previously registered in Ecuador and in other countries. Additionally, both trademarks identify products of the same International Class 25. Leaving consumers without the possibility to differentiate the signs from one another.
The Trademark Office ruled that in fact the conflicting trademarks were almost identical and could pose an imminent risk of confusion in a situation of coexistence. That decision was confirmed on appeal and consequently, the applied trademark was denied.
