Barriers That Fall, Trademarks That Move Forward: The KHAMRAH Case in Colombia Our client, Lattafa Perfumes Industries LLC, took a key strategic step to protect its KHAMRAH trademark in Colombia. Although the application is still under examination, the Superintendence of Industry and Commerce (SIC) initially refused registration, citing the trademark KHEMRA ex officio as a conflicting precedent. In response, the Intellectual Property team at Triana, Uribe & Michelsen led a non-use cancellation action against the cited registration to remove this barrier and clear the way for KHAMRAH’s approval. The action was successful: through Resolution No. 34748, the SIC cancelled the KHEMRA registration, effectively removing an obstacle and significantly increasing the likelihood of securing protection for KHAMRAH, a luxury fragrance brand with a global presence. This case illustrates the value of proactive legal strategies and technical trademark analysis in securing industrial property rights.
