On behalf of our client MSLO SHARED IP SUB LP we requested the registration of the trademark EMERIL, to identify culinary appliances, such as electric fryers, pots, smoker boxes, among others.

However, the Trademark Authority denied the registration of the sign, as it considered that the expression EMERIL, was related to the famous chef EMERIL LAGASSE, and there was no expressed consent from chef Emeril, that allowed a sign to be registered with this expression.

We filed an appeal against the decision with chef EMERIL LAGASSE’s expresses consent for the registration of the trademark EMERIL.

The Trademark Authority found that the that the document was legitimate and granted the registration of the mark EMERIL for culinary appliances.
