KRISPY KREME is protected in Colombia
The Council of State decided to protect the registration of the trademark Krispy Kreme to identify products under International Class 30 (yes donuts, among other products), denying the request of the compliant to declare null and void the registration of the trademark, with the trademark KROSPY as a base of the procedure.
This decision is one of the fastest in the Council of State’s history in intellectual property issues (less than 4 years).
In addition, it protects composite trademarks and all the distinctive elements that compose the trademark in reference.
This is a great motivation for us and a display that the proceeding instituted by the Law 1437 of 2011, allows more promptness in the development of judicial proceedings concerning administrative matters.
