New consumer protection measures in e-commerce

With the steady growth of online shopping, Colombia has updated its Consumer Protection Statute to strengthen regulations on e-commerce. These updates include:

· Faster refunds: The deadline for processing refunds has been reduced from 30 to 15 days, counted from the moment the consumer provides the required information and returns the product.

· Greater transparency: Sellers are required to provide detailed information not only about products but also about services, including restrictions on use and clear descriptions of the same.

· Clearer rules on deliveries: Orders must be delivered within the promised time frame or, if none is specified, within 30 days.

· Consumer choice in refunds: Refunds must be made through the payment method chosen by the consumer.

· Tougher enforcement of the law: The Superintendency of Industry and Commerce now has greater powers to prevent and punish violations of consumer rights.

As of November 2024, third-party claims in consumer protection actions will be rejected, as this concept is not covered by the applicable regulations.

This measure seeks to simplify legal proceedings, avoiding unnecessary delays and promoting greater efficiency in the resolution of consumer disputes. In addition, it aims to provide clarity to both consumers and suppliers on the legal mechanisms in place for the defense of rights.

It is important for companies and users to understand these new provisions in order to act in accordance with the updated legal framework and avoid potential issues in consumer-related legal proceedings.
