Nominative sets must not be Decomposed for the Trademark Comparisons

The Trademarks director denied the registration of the trademark CFA (NOMINATIVE) requested by our client CFA INSTITUTE on the basis of similar trademarks previously registered by COOPERATIVA FINANCIERA DE COLOMBIA C.F.A. such as JUVENTUD CFA (+ GRAPHIC); COMUNIDAD CFA (+ GRAPHIC) y CUENTAMAS CFA COOPERATIVA FINANCIERA (NOMINATIVE).

Consequently, our client appealed the decision arguing that when analyzing the previously registered signs in their entirety and without decomposing their phonetic unity, they were clearly differentiable from our client´s trademark.

Accordingly, the delegate Superintendent found that, in fact, when comparing the conflicted signs without decomposing their phonetic unity, no risk of confusion among them arose.

Thus, we managed to register and protect the trademark CFA (NOMINATIVE) requested by our client CFA INSTITUTE.
