In the face of a denial, you have to be creative and look for alternatives.
That was the strategy implemented to finally obtain the registration of the trademark SIRENIS (Word plus device) in international Classes 35 and 43, for our client PREMIUM TRAVELERS INTERNATIONAL INC.
Initially, the registration was denied given the opposition based on the trademark LA SIRENA in international class 35 and the prior registration of the trademark SIRENA GOURMET in international class 43 found ex officio by the Trademark Office when examining prior applications and/or registrations.
Considering the coverage of the registered trademarks, we proceeded to limit the scope of our client’s trademark application, excluding services with competitive connection.
Thus, based on the specialty principle, we obtained the registration.
