Our client Casa Editorial El Tiempo S.A., strongly opposed the application for registration of the trademark HOLA TIEMPO (MIXTA) filed by CAROLINA TABAREZ VELASQUEZ based on EL TIEMPO’s family trademarks which enjoy wide recognition in the national and international market.

During the surveillance of trademarks for our clients, our Intellectual Property department became aware of the application for registration of the trademark HOLA TIEMPO (MIXTA) to identify services included in Class 41, which are part of the coverage of services that identify EL TIEMPO’s family trademarks.

The application was contested based on the reproduction of the previously registered trademark TIEMPO, adding the word HOLA and a graphic element, which is not enough to dilute the orthographic, phonetic and visual similarities existing between the conflicting signs. The above, linked to the close relationship or connection between the services identified by each of the signs. This determines the risk of association that could be generated among consumers.

The opposition had the expected results, since the Superintendence of Industry and Commerce denied the registration of the trademark HOLA TIEMPO (MIXED) requested by CAROLINA TABAREZ VELASQUEZ, thus protecting our client’s trademarks in the market.
