Representing Akcine Bendrove Vilniaus PERGALĖ, our Intellectual Property team at Triana, Uribe & Michelsen filed a non-use cancellation action against the PERLAGE trademark, which had been cited by the Trademark Office as an obstacle to PERGALE’s registration in Class 32 (mineral waters). After demonstrating the lack of genuine use of the cited mark and the absence of a response from its owner, the Superintendence of Industry and Commerce ordered the complete cancellation of PERLAGE, effectively clearing the way for PERGALE’s registration in Colombia. This outcome not only represents a legal success but also reaffirms our belief that brands with heritage deserve real protection and a rightful place in the market.
