On October 4, 2018 the Colombian Trademark Office issued Resolution No. 75100 which confirmed the decision within the Resolution No. 59845 declaring that the opposition filed by our client JORGE MARIO VALENCIA-YEPES (the well known anchor man J MARIO), was justified, and in consequence, denying the registration of the trademark IDEAS MEDIA (plus DESIGN) to cover services of International Class 35 on behalf of IDEAS MEDIA S.A.S.
Even though, the requested mark has a graphic element that differs from the previously registered trademark, the main elements are the particles “IDEAS” and “MEDIA” that may lead to confusion with the previously registered trademark IDEA & MEDIA owned by JORGE MARIO VALENCIA-YEPES for international class 35.
Hence the Trademark Office denied the registration of the trademark that would have caused a high confusion risk in the market, thus protecting consumers rights.
