On June 28, 2018 the Colombian Trademark Office issued Resolution No. 45371 where it agreed with the opposition filed by our client FABRICA DE GRASAS Y PRODUCTOS QUIMICOS LTDA, GRASCO LTDA, and denied the trademark registration “EXPERTOS EN PANADERIA” to cover goods and services of International Classes 29, 30 and 35 respectively, filed by TEAM FOODS COLOMBIA S.A.
According to the Trademark Office the expression “EXPERTOS EN PANADERIA” must be available to be used by all the competitors in the market, prohibiting any of them to have exclusive rights over the commercial exploitation of this expression.
Hence the Trademark Office protected the consumers rights to decide unrestrictedly in the market.
