The trademarks identify goods and services of different Classes. International Class 39 protects “cruise ship services”, among others.

For owners of trademarks that cover cruise ship services and wish to enter a Port in Colombia with a vessel that identifies such services, it is possible to verify if there are other vessels sharing same name.

In Colombia, Colombian flag vessels must have a unique name which, together with the registration number, serve for its identification and individualization. This procedure is carried out before the Port Captaincies.

The question is whether there is any legal impediment for foreign vessels to enter Colombian ports, if the name of the vessel is identical or similar to another registered as Colombian flag.

The answer to this question is that, if worldwide there is another ship with the same name as a Colombian flag ship, it may enter to national ports, because it is possible to identify it by its registration number. In addition to the above, it is also possible to identify it by the call sign assigned to each ship in accordance with the provisions of the International Telecommunication Union.

Trademarks that identify ships can also sail with them.
