The Colombian Trademark Office within a trademark application proceeding, declared justified and admissible the opposition filed by our client ARIE ZEGWAARD H.O.D.N. K1DRINK.COM, and denied the registration of the trademark CANNABIS ENERGY DRINK + DESIGN to distinguish products under International Class 32 on behalf of LATINFRAGANCE INTERNATIONAL S.A.S.
With the evidence filed it was proven that the applicant was aware of the existence and use of ARIE ZEGWAARD H.O.D.N. K1DRINK.COM’s trademark CANNABIS ENERGY DRINK in the market, and followingly decided to request it under its own ownership.
Hence the Trademark Office denied the registration of a sign requested in bad faith, incurring in unfair competition practices and previously used and positioned in the market.
