The Colombian Trademark Office issued Resolution No. 79581 of 2018 by means of which it declared founded the opposition filed by our client MONSTER ENERGY COMPANY, and therefore, it denied the registration of the trademark TEQUILA BESTIA + DESIGN to distinguish goods of International Class 33 on behalf JOSE RICARDO VELASQUEZ SALAZAR.
According to the Trademark Office the compared signs are conceptually and ideologically the same because they evoke the same idea in the consumer’s mind.
In this Resolution the Trademark Office based its decision on the conceptual content of our client’s trademark MONSTER ENERGY COMPANY to deny a trademark registration which would have had created confusion among the consumers of energy and non-alcoholic drinks.
