In this case, RITUALS INTERNATIONAL TRADEMARKS B.V. had opposed the registration of RITUAL BOTÁNICO BELLEZA NATURAL, a trademark requested by MARTHA DOLLY CASTAÑO ZULUAGA. Despite an initial ruling in favor of the registration, which posed a potential threat to the client’s established brands with the common element “RITUAL”, our legal approach on appeal focused on highlighting the striking phonetic, orthographic, and conceptual similarities between the compared trademarks.
In accordance with the appeal, the second instance examiner overturned the initial decision. The appeal underscored the likelihood of confusion and led to the denial of the trademark RITUAL BOTÁNICO BELLEZA NATURAL.
