Our client ALPINA PRODUCTOS ALIMENTICIOS S.A. BIC successfully protected their trademark “Alpina alimenta tu vida” (which translates to “Alpina feeds your life) against the registration of the trademark DECAMPO ALIMENTA TU VIDA (+Graphic) requested by DECAMPO ALIMENTA TU VIDA S.A.S – ZOMAC.
To achieve this, Alpina highlighted the predominance of the nominative element for the conflicted signs, consequently arguing that the requested sign lacked distinctiveness from their trademark insofar as the former reproduces the majority of the latter´s nominative element.
Hence, the Trademarks director denied the registration of the requested sign, protecting Alpina´s trademark in the market.
